AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) govern your access to and use of the Lifekind Foundation website (the “Site”) located at https://www.lifekindfoundation.com and any related online donation, volunteer registration, or community assistance forms (collectively, the “Services”).
By accessing or using our Site, submitting a donation, registering as a volunteer, or otherwise interacting with our online Services, you agree to be legally bound by these Terms and our Privacy Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Site immediately.
We may revise or update these Terms from time to time to reflect changes in our operations, legal requirements, or service providers. Any changes become effective upon posting on the Site with the updated “Last Updated” date. Your continued use of the Site after such posting constitutes acceptance of the revised Terms.

1. ABOUT THE FOUNDATION AND OUR SERVICES
The Lifekind Foundation is a 501(c)(3) nonprofit public charity dedicated to improving community well-being by providing food assistance, outreach resources, and volunteer opportunities. All information presented on the Site is provided for general informational purposes only and should not be construed as legal, medical, or professional advice.
We may modify, suspend, or discontinue any program, initiative, or event at any time. Participation in our programs or volunteer opportunities does not create any employment, partnership, or agency relationship between participants and the Foundation.
Through our Site, visitors may:
• Make online donations;
• Register for volunteer opportunities;
• Inquire about partnership opportunities; or
• Sign up for food bank or community assistance programs.
Our Site incorporates integrations such as Wix Forms, Wix Events, Jotform, and an Event Calendar to display program information or collect form submissions. All donations are voluntary and non-commercial. We do not sell goods or services in exchange for contributions.

2. DONATIONS AND TAX RECEIPTS
a. Processing of Donations
Donations made through the Site are processed via secure third-party payment providers, including Wix Payments, Adyen, Stripe, or PayPal. These processors are independently certified as PCI DSS Level 1 compliant and transmit payment information using encryption and secure protocols.
Donors may also contribute via direct bank transfer using Zelle. Zelle transfers occur directly between your financial institution and the Foundation’s designated nonprofit business account. We do not use a third-party processor for these transfers and receive only limited donor information (such as name, email address, and donation amount). All such information is handled in accordance with our Privacy Policy and internal data-security procedures.
For all donations, we receive only limited donor details (such as name, contact information, donation amount, and transaction confirmation) for purposes of issuing receipts, accounting, and compliance with charitable solicitation laws. We do not have access to full credit or debit card numbers or security codes and do not store such information on our servers.
b. Donation Refund Policy
All donations are considered final and non-refundable except in limited circumstances such as duplicate transactions, input errors, or processing malfunctions. Refund requests must be submitted in writing within 30 days of the donation date to hello@lifekindfoundation.com, including your name, transaction ID, and reason for the request. Approved refunds will be issued to the original payment method within a reasonable timeframe.
c. Tax Deductibility and Acknowledgment
The Lifekind Foundation is recognized as tax-exempt under section 501(c)(3) of the Internal Revenue Code. Donations may be deductible to the extent allowed by law. An electronic or written acknowledgment will be provided for each donation. Donors should consult a qualified tax advisor regarding individual deductibility.
We do not provide appraisals or valuations of in-kind donations.

3. VOLUNTEER AND PROGRAM REGISTRATIONS
When registering for volunteer activities or community assistance programs, you agree to provide accurate, current, and complete information. Volunteer participation may require signing additional consent or release forms, depending on the nature of the activity.
The Foundation reserves the right to approve, deny, or remove participants from programs at its discretion to ensure safety, capacity limits, and compliance with applicable laws. By participating, you acknowledge that volunteer activities may involve certain inherent risks and you voluntarily assume those risks to the fullest extent permitted by law. Nothing in these Terms is intended to waive any rights that cannot lawfully be waived

4. INTELLECTUAL PROPERTY
All materials appearing on the Site, including text, logos, graphics, photos, videos, and design elements, are owned or licensed by the Lifekind Foundation and are protected by copyright, trademark, and other intellectual property laws.
You may view and print materials for personal, noncommercial use related to our programs. Any other reproduction, distribution, modification, or republication without our written permission is strictly prohibited.
If you believe that content on the Site infringes your copyright, you may notify us at hello@lifekindfoundation.com with sufficient detail for us to investigate the claim under the Digital Millennium Copyright Act (DMCA)

5. ACCEPTABLE USE
You agree not to:
• Use the Site for any unlawful purpose or to solicit unlawful activity;
• Upload or transmit viruses, spyware, or malicious code;
• Use automated scripts, bots, or scraping tools to collect data;
• Interfere with or attempt to disrupt the security, availability, or performance of the Site;
• Misrepresent your identity or impersonate another person; or
• Attempt to gain unauthorized access to any systems or data.
We reserve the right to monitor Site activity, suspend accounts, or block access to protect the integrity of our systems and users

6. PRIVACY AND DATA PROTECTION
Your personal information, including any data provided through Wix Payments, Zelle, Jotform, or other integrated services, is processed according to our Privacy Policy. For Zelle donations, donor details obtained through our banking records are treated as confidential and accessed only by authorized personnel.
We share data only with trusted service providers who assist us in processing donations, hosting our Site, or facilitating communication, and only for legitimate operational purposes. We retain personal information only as long as necessary to fulfill the purposes described in this Policy or as required by law.
By using our Site, you consent to the collection and processing of personal information as described in that policy. We do not sell personal information and only share it with service providers as necessary to operate the Foundation and fulfill our charitable purposes

7. DISCLAIMER AND LIMITATION OF LIABILITY
The Site and its Services are provided on an “as is” and “as available” basis for informational and charitable purposes only. While we strive to maintain secure and continuous operations, we make no representations or warranties of any kind, express or implied, including without limitation warranties of accuracy, reliability, availability, or fitness for a particular purpose.
Donations made through the Site are voluntary charitable contributions, not payments for goods or services. To the fullest extent permitted by law, the Lifekind Foundation and its officers, directors, employees, volunteers, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or relating to your use of the Site or reliance on its content. Your sole and exclusive remedy for dissatisfaction with the Site is to stop using it

8. IDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Lifekind Foundation, its affiliates, officers, employees, volunteers, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any rights of another party.

9. MODIFICATIONS AND INTERRUPTIONS
We may update, modify, or discontinue any part of the Site at any time without notice. We are not liable for any interruption or suspension of access.
Material changes to these Terms will be posted, with a new “Last Updated” date.

10. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction in those courts.

11. USER DATA
We maintain certain data that you transmit through the Site for purposes of administering donations, volunteer registrations, and community assistance programs, as well as for maintaining the functionality and security of the Site. This may include basic user information, submission history, and communications with us.
Although we perform regular backups and take commercially reasonable steps to safeguard our systems, you are solely responsible for maintaining copies of any data, communications, or confirmations you wish to retain for your own records. We are not responsible for any loss, alteration, or corruption of data resulting from circumstances beyond our control, including service interruptions, technical failures, or unauthorized access by third parties.
We may retain personal information as necessary to comply with our legal obligations, resolve disputes, maintain donation or tax records, and enforce our agreements, consistent with our Privacy Policy and applicable data-retention laws
12. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
By visiting our Site, submitting a donation, signing up to volunteer, or communicating with us electronically, you consent to receive communications from us in electronic form, including via email, website postings, and online forms. You agree that all agreements, notices, disclosures, receipts, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
You consent to the use of electronic signatures and records for all transactions conducted through our Site, including donation confirmations and volunteer sign-up submissions. You waive any requirement for original handwritten signatures, delivery, or retention of paper documents, except where prohibited by law.

13. CALIFORNIA USERS AND RESIDENTS
If you are a California resident and have a concern or complaint regarding your experience with the Lifekind Foundation that is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at:

14. MISCELLANEOUS
These Terms and any policies or rules posted on our Site constitute the entire agreement between you and the Lifekind Foundation regarding your use of the Site. Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other rights.
These Terms operate to the fullest extent permitted by applicable law. We may assign our rights and obligations under these Terms to successors, affiliates, or service providers as needed to support our charitable mission. We are not responsible for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, internet or network outages, acts of government, or labor disputes.
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. No partnership, joint venture, employment, or agency relationship is created between you and the Foundation as a result of these Terms or your use of the Site.
These Terms shall not be construed against the Foundation by reason of authorship, and you waive any defense based on the electronic form of these Terms or the lack of physical signatures by the parties.
